This promotion (“The Neil Gaiman Audio Contest") is sponsored by HarperCollins Publishers ("HarperCollins"), 10 East 53rd Street, New York, New York, 10022.

ELIGIBILITY

NO PURCHASE, DONATION, OR OBLIGATION OF ANY KIND IS NECESSARY TO WIN. A purchase or donation will not increase your odds of winning. Odds of winning depend upon the nature, quality and number of eligible entries. You have not yet won. To enter, go to neilgaiman.bookperk.com (the "Website"), complete the registration form and submit your audio file.

• Record your audio file using software such as Audacity and save in an mp3 format using their recommended software. The file should not exceed 20MB.

• The voice recorded must be your own and you may not include any additional voices or sounds.

• You may upload a profile picture but this is not a requirement.

• To claim the prize, winner must be available to be in New York City on or about May 15-16 2011 to record his or her part If you cannot be in New York City on those dates, do not enter the contest.

Your recording must be of the reading of the “Audition Paragraph” as described below. Entries with recording of other text will be rejected.

If your entry is rejected, it will be removed from the contest and we'll notify you by email. Any votes your recording received before being removed from the contest will be disqualified. Recordings must be in digital format an mp3 format. Only online entries will be eligible. No CD or other physical submissions will be accepted for entry into this Contest. All digital files must be 20 megabytes or smaller and must be in an mp3 format.

Maximum number of entries per registered user: 1

By entering the Contest, you warrant that your entry is original, that you are the sole owner and copyright holder of your entry, and that you have not granted exclusive rights to all or part of your entry to any other person or entity. You also warrant that your entry does not invade the right of privacy of any individual; does not infringe any trademark, trade name, trade secret, intellectual property right, or other common law or statutory right; nor does it contain any material that might be deemed offensive or obscene, or that otherwise violates any criminal prohibition or the personal or proprietary rights of any person or entity.

NOTE that the recordings posted on the Website will not be encrypted in any manner. While visitors cannot manipulate the recordings as posted on the Website, visitors can copy, modify and distribute the recordings without HarperCollins’s consent or approval.

The Contest is open to all legal residents of the continental United States, 21 years of age and older by 4/13/2011, excluding employees and immediate family members of HarperCollins and the Neil Gaiman team (“The Neil Gaiman Team”), and their parents, subsidiaries, affiliates, assigns, advertising, promotional and fulfillment agents, attorneys, and other representatives and the persons with whom each of the above are domiciled. Offer void in Alaska, Hawaii, outside the United States and wherever prohibited or restricted by law.

Each entrant in the Contest must be the rightful owner or have authorized use of the e-mail account indicated by the entrant's e-mail address. In the event of a dispute concerning the identity of the winner submitting an entry, the winner will be deemed to be the person in whose name the e-mail account is opened. The e-mail account must be opened prior to 9:00 a.m. (ET) on 4/13/2011.

ENTRY PERIOD

The Contest will commence on 4/13/2011 (9 a.m. ET). The last entry will be accepted on 5/02/2011 (5:00 p.m. ET). During this time period, registered users of the Website will be able to vote for recordings. Users may vote for a recording once a day. Entrants may not vote for their own recordings.

AUDITION PARAGRAPH

"Shadow was not superstitious. He did not believe in anything he could not see. He found himself watching the body language of the guards, of the other inmates, searching for a clue to the bad thing that was going to happen, as he was certain that it would."

SELECTION AND NOTIFICATION OF WINNERS

Judging will be done in two rounds. The first round will be determined by public voting on neilgaiman.bookperk.com. The second round will be determined by Neil Gaiman or a panel of HarperCollins audio specialists.

ROUND ONE (Public Voting): Public voting will begin on 4/13/2011 (9 a.m. ET) and end on 5/02/2011 (5:00 p.m. ET). Registered users will vote for the recording submissions that represent the best reading of the “Audition Paragraph”. Users may vote once per day. The 20 recordings with the most votes will be deemed "Finalists" and will move on to round two. In the event that there are less than 20 Submissions, all Submissions will move to round two.

For purposes of the Contest, a "vote" means a vote cast on the Website, by a "unique voter". A "unique voter" is an individual person (a) who has registered on the Website and (b) with unique registration information (i.e., email address) that is not duplicative of another voter. A unique voter may vote no more than once each day for a unique recording. If HarperCollins determines, in its sole discretion, that an abuse of the "unique voter" rule has occurred, HarperCollins may disqualify votes cast by such voters or contestants, including if more than 5 of such voters or contestants registered from the same computer "IP address". In the event of a tie, a panel of judges who are HarperCollins Publishers employees will determine the finalist based on the overall presentation of the tied entries. Judges' decisions are final, binding and conclusive on all matters related to the Contest.

ROUND TWO (Final Judging): Finalist Submissions will be judged by Neil Gaiman or a panel of HarperCollins audio specialists on the basis of ability to establish a sense of narrative, clarity of speech, ability to create a compelling narrative voice while interpreting the “Audition Paragraph”. Judges' decisions are final, binding and conclusive on all matters related to the Contest.

One winner will be chosen on or about 5/06/2011. All potential winners will be notified by e-mail. Potential winners may be required to sign and return to HarperCollins an affidavit of eligibility and release of liability (the "Affidavit"), and a Performer’s Agreement granting HarperCollins all rights to the Prize Recording described below. If the Affidavit and Peformer’s Agreement are not returned within 24 hours of notification, the potential winner will be deemed to have forfeited the prize, and an alternate potential winner will be chosen. No changes may be made to the Performer’s Agreement. Winner acknowledges that s/he will not be compensated for the Prize Recording.

PRIZES

One grand prize winner will be flown to and hosted in NYC on or about May 15-16 2011 where he or she will record a piece that will be featured in the upcoming audio recording of “American Gods” (the “Prize Recording”). The winner will have a phone call with Neil Gaiman himself to obtain artistic direction and ask questions about the author and his books. Additionally, the winner will be credited in the “American Gods” audio book (the “Audio Book”) for his or her contribution and receive a free copy of the audio book. Travel portion of prize consists of round-trip economy airfare for winner from the major airport nearest winner’s home to New York City, two-night hotel accommodations, All other expenses including, without limitation local transportation to airports, taxes and meals are the winner’s sole responsibility. (Approximate prize value: $ 1,500).

Prize is non-transferable and cannot be sold or redeemed for cash. Any federal, state, local, or provincial taxes are the sole responsibility of the winner.

CONDITIONS

By participating, entrants signify their acceptance of the Official Rules and decisions of the judges, which will be final in all respects, and to waive any claim with respect to ambiguity of the Official rules. By participating, Entrants grant to HarperCollins and the Neil Gaiman Team a royalty-free, non-exclusive, perpetual, worldwide license to (i) use the entry recording and the Prize Recording on the Website and in the Audio Book, and (ii) to use the Entrant's first name and address (limited to City and State) for purposes of advertising and promotion on the Website. In addition, all entrants agree to execute the Performer’s Agreement. if entrant is selected as the Winner. Entrants also agree to join the Neil Gaiman author tracker, the Audio and Bookperk newsletters. Subscribers may unsubscribe from these newsletters at any time by clicking on the “unsubscribe” link present in all mailings.

Entrants release, discharge, and hold harmless HarperCollins, The Neil Gaiman Team, their parent, affiliates, subsidiaries, and assigns, and their respective employees, attorneys, representatives and agents, including advertising, promotion and fulfillment agencies, from any and all liability or damages arising from the administration of the Contest, the use of the recordings and the names of the Entrants for purposes of advertising and publicity, and the use or misuse of any prize received in the Contest, including, without limitation, the following: (i) late, lost, incomplete, delayed, misdirected or unintelligible entries, (ii) any printing, typographical, administrative or technological errors in any materials associated with the Contest, including, without limitation, entry materials and prize notifications, and (iii) any damage to the entrant's computer and related equipment and software resulting from entrant's downloading of information regarding the Contest or participation in the Contest. Entry materials and prize notifications that have been tampered with, altered, or do not comply with these Official Rules are void. HarperCollins may only use the personally identifiable information obtained from the entrants in accordance with these Rules and its privacy policy.

HarperCollins reserves the right, in its sole discretion, to modify, cancel or suspend this Contest should a virus, bug, computer problem or other causes beyond its control corrupt the administration, security or proper operation of the Contest. HarperCollins may prohibit you from participating in the Contest or winning a prize if, in its sole discretion, it determines that you are attempting to undermine the legitimate operation of the Contest by cheating, hacking or employing other unfair practices or by abusing other entrants or the representatives of HarperCollins.

ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEB SITE OR UNDERMINE THE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND, IN SUCH EVENT, HARPERCOLLINS RESERVES THE RIGHT TO PURSUE THEIR REMEDIES AND DAMAGES (INCLUDING COSTS AND ATTORNEY'S FEES) TO THE FULLEST EXTENT OF THE LAW.

Any dispute arising from the Contest will be determined according to the laws of the State of New York, without reference to its conflict of laws principles, and the entrants consent to the personal jurisdiction of the State and Federal Courts located in the State and County of New York over them and agree that such courts have exclusive jurisdiction over all such disputes.
